We will do everything we can to make sure your off the rails experience is a success and that you have lots of fun. To ensure you know exactly what our (and your) responsibilities are please read the following terms and conditions.

CONFIRMATION AND PAYMENT.
On receiving your Booking Enquiry we will contact you by telephone or email, and will confirm prices, dates, itinerary etc. We accept payment by credit, debit card or cheque. Your trip is not booked until we have confirmed availability and taken payment.

DEPOSITS
For daily cycle hire we require either a credit card, driving licence or passport as deposit. American Express cards will incur a 2% handling fee.

TRAVEL REGULATIONS 1992.
To ensure your financial security and to comply with EC Package Travel Regulations 1992, your payment will be held in a trust account until your cycle tour is completed.

INSURANCE. We recommend that you are adequately insured. We cannot be responsible for your own illness or injury or for damage or loss to your luggage or possessions while on a ride or tour. This insurance should also cover the possibility of you having to cancel your trip.

LATE BOOKINGS AND ALTERATION.
The full tour cost becomes due at the time of booking. If you wish to alter your booking after it has been confirmed, there will be a fee of £15 per booking. If you want to transfer to another tour or change your start date - this is regarded as a cancellation.

IF YOU WISH TO CANCEL YOUR TRIP
We must receive a written notice of cancellation, signed by the person who made the booking. The following cancellation charges apply from the date of receipt of your letter.

More than 14 days before the start date - 50% of total cost.

Less than 14 days before the start date - 100% of total cost.

CANCELLATIONS/ALTERATIONS BY OFF THE RAILS.
In the unlikely event that we have to cancel a trip due to circumstances beyond our control we will make a full refund. We reserve the right to change our itinerary if the circumstances require it.

CANCELLATIONS/ALTERATIONS BY NORTHERN RAIL
We are not responsible for any delays, cancellations or other problems arising during our bike/rail trips that are due to decisions or operating procedures of Northern Rail. For full details of Northern Rail's Passenger Charter click their logo at right.

LATE ARRIVAL
We cannot offer any refunds if you fail to catch the appropriate train or fail to arrive at the designated station on time to begin your ride or tour. If you arrive too late to meet your train at the end of a bike/rail trip you will be responsible for the cost of carriage of yourself and your bike/s back to our Settle depot.

CHILDREN
Children aged between 5 and 12 years old travel
off the rails on a Tag-along bike for half price. Children under 5 yrs old travel in a Trailer free of charge. Subject to availability of Tag-along bikes and Trailers.

BOOKING FROM ABROAD.
If you are booking from outside the UK a charge of £10 is made per booking to cover increased costs. All payments must be made in Sterling. Transfer and currency exchange costs must be borne by the sender. If all communications can be completed by email, there is no charge.

SAFETY FIRST.
In the interests of safety we will only supply bicycles to those clients who take part in our initial bike briefing at the time they receive our bikes and equipment. If for any reason we are not satisfied that a customer is a competent cyclist, we reserve the right not to provide them with a bike or equipment.

HELMETS
Helmets are not compulsory on Britain's road but we supply them free and we recommend you wear them. We cannot be held responsible for any damage or injuries incurred as a result of clients not wearing a helmet.

LIABILITY
Off the Rails shall not be liable for any damages caused that are:

i) attributable to the participant or any member of his or her party, or

ii) the fault of a third party unconnected to the company or

iii) a result of unusual or unforeseen circumstances beyond the control of the company or the supplier of the service in question which could not have been predicted or avoided even after taking all reasonable care or

iv) the fault of any person who was not carrying out work for us (generally or in particular) at the time.

BICYCLES AND EQUIPMENT.
You are responsible for the care and safekeeping of the bicycle and ancillary equipment which remain the property of
off the rails at all times. You undertake to cycle carefully and sensibly at all times and to ensure that the bike is securely locked, with the bike lock provided, to an immovable object (in a safe location) when left unattended. All bicycles and equipment must be kept in a securely locked building overnight. You agree to indemnify us for any loss or damage arising from any act or default on your part, or on the part of any member of your party.

PHOTOGRAPHS SUBMITTED
Any photographs submitted to us may be used on our web site or marketing material free of copyright. A photo credit will be included if requested.

COMPLAINTS
In the unlikely event of a complaint please let us know immediately by telephone. Problems should be rectified there & then but if you remain dissatisfied we need a written complaint within 28 days of your return home. Once this has been received we will respond within 14 days.

CONFIRMATION OF ACCEPTANCE
By booking an
off the rails ride, tour or other product you are acknowledging that you have read our terms and conditions and agree to be bound by them.
